Whereas, in the action of Minerva Priest & C Plaintiffs against F. M. Collins Defendant pending in the Floyd Circuit Court an order was entered at the October Term 1892, directing John M. Weddington Master Commissioner of said County to expose for sale at public auction to the highest and best bidder the property hereinafter described; and Whereas, said property was sold in accordance with said order on the 5th day of December 1892, for the sum of One hundred and fifty one Dollars and fifteen cents, when Minerva Priest became the purchaser thereof; and Whereas, the report of said sale was confirmed by said Court at the June Term 1892 and at the September Term 1904, and order was entered directing John G. Johns Master Commissioner to execute a Deed of Conveyance of said property to said Minerva Priest but for greater certainty, the record and proceedings in said case are referred to. Now, therefore, this indenture made and entered into this 15 day of September 1894 between F. M. Collins & J. E. Priest by John G. Johns Master Commissioner of the said Court of the first part and Minerva Priest of the second part. Witnesseth, that for and in consideration of the premises, the party of the first part, John G. Johns Master Commissioner of said County aforesaid, has sold and by this writing do convey to said party of the second part and her heirs and assigns forever, the following described property, to-wit: Beginning on a gum and beech on the Wolf branch corner of survey made in the name of Pernina James ? with said survey to the terminus of it. Thence up the hill to two chestnuts on top of the hill at the head of Cow fork S86E40 poles to 3 forked chestnuts on a high know S35E40 to a chestnut oak same course 40 poles S74W200 poles to the Beginning. 2nd tract . Beginning on an oak and beech on the Kit Narrow branch, thence with the dividing line between K. N. Taylor & John Priest to the Cow fork gap. Thence with the meets and bounds of said Survey to the Beginning. To have and to hold said property, and warrants the title thereto, so far as he is authorized by the orders and proceedings in said cause and no further; but he does not bind himself personally by anything contained herein in any event whatever. In Testimony whereof, said John G. Johns Master Commissioner aforesaid has hereunto subscribed his name this 15th day of September 1894.
